The Directorate of Public Prosecution (DPP) have moved to withdraw a graft case that was filed against the former football boss according to the Penal Code. The case was withdrawn late Wednesday according to section 87 of the Penal Code. This is what the state said in a statement; “The Director of Public Prosecutions (DPP) has withdrawn the case against former Football Kenya Federation (FKF) President Nick Mwendwa in accordance with Section 87 of the Penal Code.” The DPP had applied for an adjournment of the case on Tuesday arguing they had no witnesses and wanted to review the evidence, but their application was denied by the court, which directed that they come ready to proceed with the case on Wednesday. The DPP then tried again on Wednesday to have the case adjourned but it was again declined by the court which made them to apply to withdraw the case.
Mwendwa's woes started on 21st November last year when the Cabinet Secretary in charge of the Ministry of Sports, Culture, and Heritage; Ambassador Amina Mohamed moved to disband the federation citing alleged misappropriation of funds by Mwendwa’s regime. A day after that the former FKF President was arrested and arraigned in court where he was charged with fraud. However, he was released when the Milimani Senior Principal Magistrate ordered that Mwendwa’s Sh4 million cash bail be refunded to him after the prosecution failed to press charges against the suspended FKF administrator. A day after the court proceedings Mwendwa was again arrested and taken to the Directorate of Criminal Investigations (DCI) headquarters on Kiambu Road. This arrest forced Mwendwa to step aside as the FKF President.
The move by the government to disband FKF made the world football governing body; the Federation of International Football Associations (FIFA) to impose an indefinite ban on Kenya citing third-party interference which is intolerable to FIFA. While Mohamed tried to engage Fifa for reinstatement, the world body maintained they can only lift the ban if the government reinstates Mwendwa and his team to office. Kenya has remained suspended since then with the national team Harambee Stars being denied a chance to take part in the 2023 Afcon qualifiers for Ivory Coast and the women's team Harambee Starlets missing out on the qualification for the 2022 Women Africa Nations finals in Morocco.
